1. Services Provided

Smart Website 360 provides website design and hosting, lead capture, automated follow-up and messaging, appointment booking, review management, and related marketing services for local service businesses. Specific features depend on the plan you subscribe to.

2. Use of Our Services

By using Smart Website 360, you agree to provide accurate and complete information, to use our services lawfully, and not to disrupt or interfere with our services, website, or network. You are responsible for the content you provide and for ensuring you have the right to use it.

3. Subscription, Billing, and Cancellation

• Our services are provided on a recurring subscription basis and renew automatically until cancelled.
• Fees are billed in advance for each billing period.
• You may cancel at any time. Cancellation takes effect at the end of your current billing period.
• Because these are marketing and platform services delivered on an ongoing basis, payments are non-refundable, including for partial billing periods. There is no long-term contract and no cancellation fee.
• Late or failed payments may result in suspension or termination of services.

4. Website Hosting and Access

Your website is provided as part of your active subscription and is hosted and maintained by us on an ongoing basis. Access to your website, and the services connected to it, ends when your subscription ends. Content you supplied to us, such as your business information, text, and images, remains yours and can be provided to you on request. Any custom domain you own remains yours.

5. SMS Communication

• Opting out: you can cancel SMS messages at any time by replying STOP. A confirmation will be sent and messages will stop.
• Support: reply HELP, or get in touch through our contact page.
• Carrier liability: carriers are not liable for delayed or undelivered messages.
• Fees: standard message and data rates may apply.

You are responsible for ensuring that any messages sent through the platform to your own customers comply with applicable law, including obtaining any required consent.

6. Call Recording

Calls handled through the platform, including calls answered by our automated voice assistant, may be recorded for quality assurance and system improvement. See our Privacy Policy for details.

7. Results and Performance

We provide tools and services designed to help you capture and convert more leads. We do not guarantee any specific results, revenue, ranking, or number of leads or bookings. Any figures shown on our website are illustrative or drawn from third-party research and are not a promise of individual outcomes.

8. Intellectual Property

All content, branding, software, and technology used to deliver Smart Website 360 are the property of Online Impact 360, LLC and may not be copied, reproduced, or redistributed without permission. You retain ownership of the content you provide to us.

9. Third-Party Services

Our services rely on third-party providers for functions such as hosting, messaging, payments, and calendar integration. We are not responsible for interruptions, changes, or failures originating with those providers.

10. Limitation of Liability

To the fullest extent permitted by law, Online Impact 360, LLC is not liable for service interruptions or technical issues beyond our reasonable control, losses arising from third-party integrations or cyber incidents, or indirect, incidental, or consequential damages arising from use of our services. Our total liability for any claim is limited to the amount you paid us in the three months preceding the claim.

11. Termination

We may suspend or terminate services for any user who violates these terms or engages in unlawful activity.

12. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any dispute will be brought in the state or federal courts located in Miami-Dade County, Florida.

13. Changes to These Terms

We may update these Terms from time to time. Changes will be posted with an updated effective date, and continued use of our services constitutes acceptance.
